These Terms of Service ("Terms") govern your use of the Hola Rides transportation booking platform operated by Traction Numérique Inc., a corporation incorporated under the laws of Québec, Canada, operating under the commercial name Hola Rides ("we", "our", or "us") at hola-rides.com (the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms.
About our structure: Traction Numérique Inc. is a technology company incorporated in Québec, Canada. The transportation services facilitated through our Platform are delivered by independent operators and drivers located in Costa Rica. By using the Platform, you are contracting with the Canadian entity for booking and platform services, while the physical transportation is subject to Costa Rican regulations.
If you do not agree to these Terms, please do not use the Platform. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.
1. Our Services
Hola is a transportation booking platform connecting travelers with transportation providers operating across Costa Rica. We offer three types of services:
Exclusive, direct transportation for your group from one location to another. The vehicle is reserved solely for your party.
Scheduled departures on set routes shared with other passengers. Subject to availability and minimum passenger requirements.
Peer-to-peer ride sharing connecting drivers and passengers traveling the same route in Costa Rica.
Hola acts solely as a technology intermediary and booking platform. Transportation services are provided by independent operators and drivers in Costa Rica, not by Hola directly. Hola is not a transportation carrier.
2. Eligibility
To use the Platform, you must:
- Be at least 18 years of age, or have parental/guardian consent
- Provide accurate and complete information when booking
- Have the legal authority to agree to these Terms on behalf of yourself or any party you represent
- Not be prohibited from using the Platform under applicable law
3. Bookings
When you submit a booking through the Platform, you are making an offer to purchase transportation services. A booking is only confirmed when you receive a written confirmation from us via email. We reserve the right to decline any booking.
You are responsible for providing accurate pickup/dropoff locations, travel dates, passenger counts, and any special requirements. Errors may result in failed pickups or additional charges.
- Please be ready at the agreed pickup location at least 10 minutes before scheduled departure
- For shared shuttles, drivers may depart if passengers are not present at the scheduled time
- Hola is not responsible for missed pickups due to late arrival by the passenger
The number of passengers stated at booking must not exceed the vehicle's licensed capacity. Drivers have the right to refuse service if the actual passenger count exceeds the booked amount.
4. Cancellations & Refunds
Our cancellation policy depends on the service type and timing:
48+ hours before departure — Full refund
Cancel at least 48 hours before your scheduled departure for a full refund, minus any payment processing fees.
24–48 hours before departure — 50% refund
Cancellations made between 24 and 48 hours before departure are eligible for a 50% refund.
Less than 24 hours before departure — No refund
Cancellations within 24 hours of departure are non-refundable. No-shows are non-refundable.
Service cancellation by provider
If a transportation provider cancels your confirmed booking, you will receive a full refund or the option to rebook.
To cancel a booking, contact us at support@hola-rides.com or via WhatsApp. Refunds are processed within 5–10 business days to the original payment method.
5. Payments
All prices are displayed in US Dollars (USD) unless otherwise stated. Prices include applicable taxes and fees. Payment is required in full at the time of booking.
Payments are processed securely through Stripe, a third-party payment processor. By providing your payment details, you authorize us to charge the full booking amount. Hola does not store your full card details.
In the event of a pricing error, we reserve the right to cancel any booking and provide a full refund, notifying you as soon as possible.
6. User Conduct
When using our Platform and transportation services, you agree to:
- Treat drivers, operators, and other passengers with respect
- Not bring prohibited items including illegal substances or hazardous materials
- Not engage in behavior that endangers safety or disturbs other passengers
- Comply with Costa Rican traffic laws and regulations during your ride
- Not use the Platform to make fraudulent bookings or provide false information
- Not attempt to circumvent the Platform to book directly and avoid fees
We reserve the right to refuse service or cancel bookings without refund for violations of these conduct standards.
7. Limitation of Liability
Hola acts as a technology platform and intermediary. The physical transportation services are provided by independent operators in Costa Rica. To the maximum extent permitted by applicable law:
- We are not liable for delays, route changes, or service interruptions caused by traffic, weather, road conditions, or other circumstances beyond our control
- We are not liable for loss, damage, or theft of personal belongings during transit
- Our total liability to you for any claim arising from use of the Platform shall not exceed the amount you paid for the specific booking giving rise to the claim
- We are not liable for indirect, incidental, or consequential damages
Nothing in these Terms limits liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under Canadian or Québec law.
8. Intellectual Property
All content on the Platform including text, images, logos, and software is owned by or licensed to Hola and is protected by Canadian copyright law and applicable intellectual property legislation. You may not copy, reproduce, distribute, or create derivative works without our prior written consent. You may use the Platform solely for personal, non-commercial booking purposes.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. We comply with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and Québec's Act respecting the protection of personal information in the private sector (Law 25).
10. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Québec, Canada.
Note on transportation services: The physical transportation services take place in Costa Rica and are subject to Costa Rican traffic and transportation regulations. Claims arising specifically from the conduct of drivers or operators during a trip may also be governed by applicable Costa Rican law.
Before initiating formal legal proceedings, we encourage you to contact us directly to resolve any dispute informally. Most issues can be resolved quickly through open communication.
11. Changes to These Terms
We may modify these Terms at any time. We will update the "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify registered users by email as required under applicable Canadian consumer protection law. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
